Terms and Conditions

• Prepayments of 25% will be required before shipment of your order.
• A 10% discount on the entire order can be received by paying 25% within 30 days of placing your order and receiving your confirmation.
• No orders for future delivery can be booked until all previous seasons accounts are paid in full.

Claims
All shipments must be inspected upon arrival and any product related claim submitted in writing within 10 days of receipt of order. Only claims related to product quality should be brought to our attention. If buyer does not give such notice, buyer agrees to have irrevocably and unconditionally accepted goods. All unsatisfactory or rejected goods must be held for our advice or disposition.

FOB/Packing
FOB shipping point. Shipping and packing expenses are charged at cost and will be listed as separate line when invoiced. Any freight related claim is the responsibility of the carrier. Buyer shall address freight claims to the carrier.

Collections
Seller retains a security interest in all plant material until fully paid for. In the event repossession or collection becomes necessary, buyer will pay for all costs of collection and repossession. Costs include, but are not limited to court costs and reasonable attorney’s fee, and attorney’s fees on appeal, whether or not prosecuted to final judgement.

Cancellations
Cancellations of order(s) shall be in writing; orders canceled after January 1, will be charged a 25% restocking fee. Oakview Nursery Inc. reserves the right to cancel any orders if is in our best interest to do so. Circumstances such as; flood, fire, hail, frost, drought, or any other act beyond our control. Notification will be sent to buyer if any such an act should occur.
